FULFILMENT OF INFORMATIONAL OBLIGATION, ACCORDING TO GDPR

Dear Sir or Madame,

By virtue of the regulation (EU) 2016/679 of the European Parliament and of the Council of 27^th April 2016 on the protection of personal data (GDPR), which came into force on the 25^th May 2018, we present below the principles of collecting and protecting of such data, used by our office.

Purposes and basis for the processing:

Your personal data are processed for the following purposes:

realization of an order for translation service, including conducting customer satisfaction surveys, regarding the level and quality of the services, provided by Sopoltrad Polska limited liability company limited partnership (basis: art. 6 point. 1 letter “b” GDPR);
documenting of the realization of orders and their financial settlement, by virtue of the tax and accounting law (basis: art. 6 point 1 letter “c” GDPR);
necessary to conduct recruitment process, as well as for the purpose of future recruitment processes (basis: art. 22¹§ 1 of the Labour Code read with art. 6 point 1 letter “c” GDPR and art. 6 point 1 letter “a” GDPR);
internal purposes of the Controller, including statistics and internal reporting, being pursuance of our legitimate interest (basis: art. 6 point 1 letter “f” GDPR);
archival (evidential), being pursuance of our legitimate interest to secure information in the event of legal necessity to prove facts (basis: art. 6 point 1 letter “f” GDPR);
potential establishment, exercising or defending of legal claims, being pursuance of our legitimate interest (basis: art. 6 point 1 letter “f” GDPR);
offering you by Sopoltrad Polska limited liability company limited partnership, products and services of the office (direct marketing) (basis: art. 6 point 1 letter “a” GDPR);
analytical – better selection of services to the needs of our clients, general optimization of our products, optimization of service processes, building knowledge about our partners, being pursuance of our legitimate interest (basis: art. 6 point 1 letter “f” GDPR);
for the archival (evidential) purposes, being pursuance of our legitimate interest to secure information in the event of legal necessity to prove facts (basis: art. 6 point 1 letter “f” GDPR);

Recipients of data:

We may transfer data to the following categories of entities: persons authorized by us, our employees and collaborators, who must have access to the data in order to execute their duties, entities processing personal data at the order of the Controller including, among others, co-working firms from the scope of IT, firms rendering HR and payroll services, translators – exclusively and pursuant to Controller’s requirements.

Period of storage:

Data, processed for the purpose of direct marketing of our products and services, based on the consent, we can process until you withdraw your consent granted in this scope or we establish, that the data have become outdated. Data, processed on the basis of legitime interest of the Controller, we can process until legitime interests of the Sopoltrad Polska limited liability company limited partnership, being the basis of such processing, are fulfilled or until you lodge an objection to such processing. Data, processed in the remaining scope, we may process for a period no longer than 5 years in the event, when a mandator of the translation service is an entrepreneur or 10 years in the event, when a mandator of the translation service is a natural person.

Transferring data outside EEA:

Due to the fact, that Sopoltrad Polska limited liability company limited partnership cooperates with partners, having their registered offices outside European Economic Area, personal data may be transferred to the countries, not being members of the EEA.

In order to ensure an adequate level of security of the personal data, transferred to the countries, for which the European Commission has not declared an adequate level of protection, Sopoltrad Polska limited liability company limited partnership uses the standard data protection clauses, adopted by the European Commission, as specified in art. 46 point 2 letter “c” GDPR. The clauses are available in the Internet, on the European Commission’s website (ec.europa.eu) or in the registered office of the Sopoltrad Polska limited liability company limited partnership (for inspection).

Rights regarding processing of personal data:

You have the right to: request from the Controller access to personal data and to receive copy of them, right to rectify personal data, erase of personal data or restrict of processing the personal data, right to lodge an objection to processing, as well as right to data portability.

Regarding personal data, processed on the basis of your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

In order to exercise your rights, please lodge a demand on the e-mail: sopoltrad@sopoltrad.com. Remember please, that before realization of your rights we would have to ensure, that you are you, that is to identify you properly.

Right to lodge a complaint:

Should you decide, that processing of personal data concerning you, breaches the principles of GDPR, you have the right to lodge a complaint to the President of the Personal Data Protection Office.

Requirement to submit personal data:

Submission of personal data is voluntary, although necessary to attain the abovementioned purposes.
